Failure to Follow Care Plans

When Failing to Follow a Medical Care Plan Results in Injury or Death of a Senior

Hayward, California Medical Malpractice Lawyers

It's often the case that a senior citizen enters a nursing home or care facility after a stay at the hospital. They may have suffered a broken hip from a fall at home or had a sudden worsening of diabetes because of poor eating habits. They go to the hospital for immediate treatment and then are released to a nursing home for follow-up care before going home.

Unfortunately, neglect in the nursing home, or failure to follow the medical care plan developed by the doctor can lead to a worsening medical condition. Instead of going home, they become dependent and unable to care for themselves.

This is wrong. Senior citizens deserve quality care that allows them to recover to the fullest of their ability.

If you believe your loved one has suffered neglect in a nursing home, hospital or long-term care facility, contact an elder law attorney at Lin/Santo LLP in Joint Venture with Furtado, Jaspovice & Simons in Hayward, California. Call us toll free at 877.LAW.1080 for a free initial interview.

Failing to follow the care plan can occur because of nursing home understaffing — staff do not take the time to fully follow the plan. Sometimes staff have not communicated the care plan to the aides. Sometimes staff simply fail to act on the care plan. This could be the result of training or supervisory problems.

Unfortunately, family members often cannot be certain that bad care has occurred. They see their loved one deteriorating but they do not know that the care plan has not been followed until far too late — when they talk to a lawyer after a serious injury or premature death and there is a review of the medical record.
